Terms of Service

By accessing or using ghoste.trade (the "Site") or any services provided by Ghoste ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, do not access or use our services. These Terms form a legally binding agreement between you and Ghoste.

Ghoste is a non-custodial, private meta-aggregator for Solana token swaps. Our platform:

• Fetches swap quotes from multiple Solana DEX aggregators (Jupiter, DFlow, Titan Prime) in parallel
• Ranks routes by net output after fees, tips, and slippage
• Executes the best-priced trade via Vanish Core's private execution layer using a one-time wallet
• Provides MEV protection by obscuring the link between your primary wallet and your on-chain trade activity

Ghoste does not take custody of your funds, hold or access your private keys, or act as a counterparty to your trades. All transaction signing is performed by your connected wallet (Phantom, Solflare, or compatible). Ghoste is a software interface, not a financial institution, broker, or investment advisor.

To use Ghoste, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding agreements in your jurisdiction
• You are not located in, incorporated in, or a citizen or resident of any jurisdiction subject to US OFAC sanctions or other applicable export control restrictions
• Your wallet address is not on any OFAC, UN Security Council, EU, or UK HMT sanctions list
• You are not acting on behalf of any sanctioned person, entity, or government
• Use of Ghoste does not violate any law, regulation, or rule applicable to you

We reserve the right to verify eligibility and to restrict or terminate access for any user we determine does not meet these requirements.

Ghoste is a non-custodial protocol. We explicitly do not:

• Hold, store, or control your private keys at any point
• Take possession of your funds before, during, or after a trade
• Guarantee execution, settlement, or completion of any transaction
• Act as a broker-dealer, financial advisor, or money transmitter

You are solely responsible for the security of your wallet, seed phrase, and private keys. Ghoste cannot recover lost funds, reverse transactions, or intervene in the execution of on-chain trades.

Ghoste screens all wallet addresses against OFAC sanctions lists and the Range compliance database on every deposit and withdrawal. This screening is a legal requirement and cannot be waived, bypassed, or opted out of. We reserve the right to refuse service, block access, or freeze interaction with any wallet address that appears on a sanctions list or is associated with prohibited activity. Using Ghoste to evade, circumvent, or undermine applicable sanctions is strictly prohibited and may be reported to relevant authorities.

Ghoste's private execution layer is powered by Vanish Core, operated by Vanish Technology Corporation. By using Ghoste, your trade data is routed through Vanish's infrastructure and you are also subject to Vanish's Terms of Service and Privacy Policy. Ghoste is not responsible for disruptions, delays, errors, or failures in Vanish's services. In the event of a conflict between these Terms and Vanish's terms with respect to execution services, Vanish's terms govern.

Cryptocurrency trading involves substantial and potentially total loss of funds. By using Ghoste, you acknowledge and accept the following risks:

• Smart contract risk — bugs, exploits, or vulnerabilities in routing contracts or protocols may result in loss of funds
• Slippage risk — the executed price may differ materially from the quoted price due to market movements between quote and execution
• Market risk — token prices are highly volatile and can fall to zero
• Network risk — Solana network congestion, outages, or validator issues may delay or prevent trade execution
• MEV risk — Ghoste mitigates but cannot fully eliminate the risk of MEV extraction or sandwich attacks
• Regulatory risk — applicable laws governing cryptocurrency trading may change, potentially restricting or prohibiting use of our services
• Counterparty risk — third-party protocols (Jupiter, DFlow, Titan Prime, Vanish Core) may have their own bugs, downtime, or failures

You should only trade amounts you can afford to lose entirely. Ghoste does not provide financial, investment, or legal advice.

You agree not to use Ghoste to:

• Evade, circumvent, or violate OFAC or any other applicable sanctions regime
• Launder money, finance terrorism, or engage in any other illegal financial activity
• Violate any applicable law, regulation, or rule in your jurisdiction
• Interfere with, disrupt, or degrade our infrastructure, services, or other users' access
• Reverse-engineer, decompile, or attempt to extract the source code of our proprietary software
• Introduce malware, viruses, or malicious code into our systems
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Scrape, harvest, or mass-collect data from our site without written consent

Violation of these prohibitions may result in immediate termination of access and, where appropriate, referral to law enforcement.

Joining the Ghoste waitlist does not constitute a contract, reservation, or guarantee of access to our platform. We reserve the right to grant or deny access to any individual at our sole discretion, and to modify or discontinue the waitlist program at any time without notice or liability.

All content, branding, logos, software, and technology on the Site are owned by Ghoste or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any part of our Site or services without our prior written consent.

Our services are provided "as is" and "as available" without warranty of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any quotes, prices, or information provided through our interface.

To the maximum extent permitted by applicable law, Ghoste and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including any loss of funds, tokens, revenue, data, goodwill, or profits, arising out of or in connection with your use of or inability to use our services — even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claims arising under these Terms shall not exceed one hundred US dollars (USD $100).

You agree to indemnify, defend, and hold harmless Ghoste and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of our services, your violation of these Terms, your violation of any applicable law or regulation, or your violation of any third party's rights.

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms or our services that cannot be resolved informally shall be submitted to binding arbitration. Nothing in this section prevents either party from seeking injunctive or other equitable relief for violations of intellectual property rights or breaches that cause irreparable harm.

We may update these Terms at any time. When we do, we will post the revised Terms on this page with an updated effective date. For material changes, we will notify waitlist subscribers by email where practicable. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using our services.
